Tips on making FOIA requests

  • Who to ask?
In general, if you want to know more about what's happening in your school district, go to their website and look for a "FOIA compliance officer" or the records custodian. If there does not seem to be someone on staff along those lines, go directly to the Superintendent--after all, the buck stops there!

If you want records held by the county, the person to ask is the County Clerk. Frequently, they will dump your request off onto a Deputy County Clerk or a Records Custodian (or a lawyer!), but it is generally the County Clerk that has final control over document access.

Similarly to counties, the record overseer in cities, towns, and municipalities is the City (or Town) Clerk.

If you are looking for documents held by the state, check their website for a FOIA Compliance officer.

  • What to ask?
"While the request should be broad enough to encompass all records that you seek, a request without reasonable subject matter and/or time limitations may be denied as overly broad. Excessively broad requests can also lead to substantial charges for locating and copying records." Godfrey & Kahn, S.C.
The above was written specifically in terms of Wisconsin law, but the idea is applicable everywhere. You want your request(s) to be specific enough that people know what you're talking about, but not so specific that a records custodian might not include applicable items just because you only asked for one document.
